Please read carefully. By creating an account or using the OAP platform you agree to be bound by these Terms. If you do not agree, do not use OAP.

1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the On Air Proof platform ("OAP", "Service") operated by Nu World Entertainment ("Company", "we", "us"). By registering, logging in, or otherwise using OAP you confirm that you have read, understood, and agree to these Terms in full, including our Privacy Policy, Refund Policy, and Deletion Policy, which are incorporated by reference.

2. What OAP Does

OAP is a B2B radio broadcast compliance platform that:

  • Accepts audio commercial materials uploaded by registered advertising agencies
  • Registers audio fingerprints with ACRCloud for continuous monitoring
  • Monitors live Nigerian radio station streams 24 hours a day, 7 days a week
  • Detects broadcast occurrences and records off-air dub evidence
  • Generates printable proof-of-play documents: Media Purchase Orders, Certificates of Transmission, and ARCON Compliance Certificates
  • Provides campaign scheduling and broadcast management tools
  • Enables radio stations to review and confirm compliance logs submitted by agencies
  • Allows team management for agencies with Senior and Veteran subscriptions

OAP is a verification and documentation tool. We do not buy, sell, or broker advertising airtime. We are not a radio station or a broadcast regulator.

3. Eligibility & Account Registration

  • You must be a legally registered business or professional operating in Nigeria
  • You must be at least 18 years old
  • One account per company — duplicate accounts may be suspended without notice
  • You are responsible for maintaining the confidentiality of your login credentials
  • You must provide accurate, current, and complete information during registration and keep it updated
  • Email addresses belonging to previously closed accounts may not be re-registered
  • OAP may require identity verification (KYC) before granting full access to paid features
  • Radio station accounts are free and do not require a subscription, but KYC verification is required
  • By registering, you confirm that you have read and agree to these Terms, our Privacy Policy, and our Deletion Policy
  • You may register using Google Sign-In, subject to Google's own terms of service

4. Subscriptions & Billing

4.1 Subscription Plans

OAP offers tiered subscription plans (Junior, Senior, Veteran, etc.) with different levels of monitoring, storage, and document generation. Plan details, pricing, and feature limits are displayed on the Subscription page.

4.2 Pricing & VAT

All prices are displayed in Nigerian Naira (₦) and are exclusive of VAT. A VAT charge of 7.5% (as required by Nigerian law) will be added at checkout and shown separately before payment is processed.

4.3 Payment

Payments are processed securely by Flutterwave or Paga. By subscribing you authorise the applicable payment gateway to charge the subscription amount plus VAT to your nominated payment method. OAP does not store card details.

4.4 Subscription Period

Subscriptions are billed per the selected plan period (monthly or annual). Your subscription is active from the date payment is confirmed. Subscriptions do not renew automatically — you must manually re-subscribe upon expiry.

4.5 Failed Payments

If a payment fails, your account will revert to the free tier until payment is completed. Monitoring continues for 48 hours after expiry to allow renewal.

5. Acceptable Use

You agree not to:

  • Upload audio content that infringes third-party intellectual property rights
  • Upload malicious files, viruses, or files designed to harm our systems
  • Attempt to reverse-engineer, scrape, or otherwise extract data from OAP without permission
  • Use OAP to monitor radio stations for any purpose other than verifying your own legitimately purchased airtime
  • Share, sell, or transfer your OAP account or its outputs to third parties without written consent
  • Fabricate or alter broadcast evidence for fraudulent insurance, billing, or regulatory claims
  • Use automated scripts or bots to access the platform
  • Circumvent account closure restrictions by registering with a different identity

Violation of acceptable use may result in immediate account suspension and referral to relevant authorities.

6. Uploaded Content & Intellectual Property Rights

You retain full ownership of all audio files and campaign materials you upload to OAP. By uploading, you grant Nu World Entertainment a limited, non-exclusive, royalty-free licence to:

  • Store and process the audio solely for fingerprint registration and monitoring purposes
  • Submit fingerprint hashes (not the audio itself) to ACRCloud for matching
  • Generate broadcast evidence documents referencing your campaign

This licence terminates when you delete the material or close your account. OAP will never use your commercial content for any purpose beyond verification.

You represent and warrant that you have the legal right to upload and broadcast the audio material and that doing so does not violate any third-party rights or ARCON regulations.

7. Audio Fingerprinting & Monitoring

OAP uses ACRCloud's audio fingerprinting technology. You acknowledge that:

  • Detection accuracy depends on audio quality, station stream stability, and fingerprint registration success
  • OAP cannot guarantee 100% detection of every broadcast occurrence
  • Monitoring covers only stations whose live streams are accessible to OAP at the time of broadcast
  • A failed fingerprint registration (e.g., due to audio quality or format issues) does not entitle you to a refund unless the failure is directly attributable to OAP's systems
  • Off-air dub recordings are captures of publicly broadcast radio — OAP does not pay royalties on these recordings as they are produced for evidential purposes only

8. Documents & Certificates

Documents generated by OAP (Media Purchase Orders, Certificates of Transmission, ARCON Certificates) are:

  • Based on data recorded within the OAP system
  • Intended as supporting evidence for billing reconciliation and regulatory compliance
  • Not a substitute for official documents issued by a radio station or ARCON itself

OAP makes no representation that these documents will be accepted by any third party, regulator, or court. Users are responsible for independently verifying any compliance requirements.

9. Account Suspension & Termination

We may suspend or terminate your account immediately and without prior notice if:

  • You breach any of these Terms
  • Payment fraud or chargebacks are detected
  • Your account is used for illegal activity
  • We are required to do so by law

You may close your account at any time from your Profile page. Upon account closure:

  • Your email address is permanently blocked from future registration
  • Active subscriptions are not refunded (see Refund Policy)
  • Your data is retained for legal compliance purposes then anonymised after 90 days

10. Disclaimer of Warranties

OAP is provided "as is" and "as available" without any warranty, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that all broadcasts will be detected.

11. Limitation of Liability

To the fullest extent permitted by Nigerian law, Nu World Entertainment's total liability to you for any claim arising out of or relating to OAP shall not exceed the total subscription fees paid by you in the 3 months immediately preceding the event giving rise to the claim.

We are not liable for: indirect, incidental, special, consequential, or punitive damages; loss of revenue or profits; missed broadcast detection; or third-party service failures (ACRCloud, Flutterwave, hosting providers).

12. Indemnification

You agree to indemnify and hold harmless Nu World Entertainment, its directors, employees, and agents from any claims, damages, fines, or expenses (including legal fees) arising from: your use of OAP; your uploaded content; your violation of these Terms; or your infringement of any third-party right.

13. ARCON & Regulatory Compliance

The Advertising Regulatory Council of Nigeria (ARCON) is the statutory body governing advertising in Nigeria. OAP's compliance certificates are generated based on our monitoring records and are designed to support — not replace — your obligations under ARCON regulations. You remain solely responsible for:

  • Obtaining proper ARCON approval for your commercial materials before broadcast
  • Ensuring your agency is duly registered with ARCON
  • Compliance with the Nigerian Broadcasting Commission (NBC) Code

14. Google Sign-In & Third-Party Authentication

OAP offers Google Sign-In as a registration and login option. By using Google Sign-In:

  • You authorise OAP to receive your basic profile information (name, email, avatar) from Google
  • You acknowledge that Google Sign-In is subject to Google's own Terms of Service and Privacy Policy
  • OAP is not responsible for Google's service availability or data handling practices
  • If Google modifies or terminates access to their OAuth service, your ability to log in via Google may be affected — you can set a password from your Profile page as an alternative

15. Identity Verification (KYC) & Dojah

OAP requires identity verification (Know Your Customer) for agencies and station accounts before granting access to paid features. By submitting KYC documents:

  • You consent to your CAC registration number and/or National Identification Number (NIN) being sent to Dojah (a third-party identity verification service) for instant verification against government databases
  • Dojah returns verification results (company name, individual name, registration status) which OAP stores to support audit and compliance
  • No raw ID documents, selfie images, or sensitive files are shared with Dojah — only registration/identification numbers
  • If all Dojah checks pass (valid CAC + valid NIN), your account may be auto-approved without manual review
  • If any check fails or your ID type cannot be auto-verified (e.g. passport, driver's licence), your submission enters manual review by OAP staff
  • You may optionally use your device camera to capture ID documents and selfie photos; camera access is permission-based and can be revoked at any time
  • KYC documents are stored securely and deleted within 30 days of account closure
  • Dojah's services are subject to their own terms and privacy policy at dojah.io/privacy

Submitting forged, stolen, or falsified identity documents is a criminal offence under Nigerian law and will result in immediate account termination and possible referral to law enforcement.

16. Radio Station Accounts

Radio station accounts are provided free of charge to enable broadcast compliance verification. Station account holders agree to:

  • Provide accurate station identity and contact information
  • Complete identity verification (KYC) when requested
  • Review compliance logs honestly and in good faith — submitting verdicts that accurately reflect whether spots were broadcast
  • Respond to compliance review requests within a reasonable timeframe (recommended: within 7 business days)
  • Not collude with agencies to fabricate or falsify compliance verdicts

OAP reserves the right to suspend station accounts that repeatedly submit false or unreliable compliance verdicts, or that fail to engage with the compliance review process.

17. Campaign Management

Campaigns allow you to organise multiple adverts under a single client or project. Campaign terms:

  • Campaign names and references must not contain misleading, offensive, or trademark-infringing content
  • Campaign status transitions (active, paused, halted, ceased, terminated, completed) are logged with timestamps and reasons — these logs cannot be deleted or modified by users
  • Audio files attached to campaigns may be reused across multiple campaigns
  • Mid-campaign audio replacement is permitted; the previous audio's detection history is preserved
  • Campaigns and their audit trails are retained as part of your account data and are subject to the Data Retention terms in our Privacy Policy

18. Compliance Contest (Back-Check) System

The compliance contest system enables agencies and radio stations to jointly verify broadcast performance. Terms:

  • Agencies create compliance logs and send them to stations for review. The agency is responsible for the accuracy of the scheduled spots listed in the log.
  • Stations review each spot and submit verdicts (confirmed, disputed, missed). The station is responsible for the accuracy of their verdicts.
  • Once a compliance log is submitted for review, the agency cannot unilaterally modify it — the station's review verdicts are final unless both parties agree to a correction
  • Compliance data (logs, verdicts, rates) may be used by OAP in anonymised and aggregated form for industry reporting and platform improvements
  • Neither party may use compliance data obtained through OAP for purposes outside of broadcast verification without the other party's consent

19. Team Management

Senior and Veteran subscribers may add team members to their account. Team management terms:

  • The account owner is responsible for all actions performed by their team members on the platform
  • Team members are granted access based on the role (manager, department head) and permissions assigned by the owner
  • Team member credentials are created by the account owner — the owner must ensure team members are informed of and comply with these Terms
  • The account owner may deactivate or remove team members at any time; removed members lose access immediately
  • Team member limits are determined by the subscription plan — exceeding the limit requires a plan upgrade
  • Team members may not independently create sub-teams or add additional members

20. Data Deletion & Account Closure

You may request deletion of your account and data at any time. Full details are set out in our Data Deletion Policy. Key terms:

  • Account deletion is permanent and irreversible
  • Certain data is retained after deletion as required by Nigerian law (payment records for 7 years, email hash permanently)
  • If your account participates in compliance logs with other parties, anonymised compliance data may be retained for the other party's records
  • Team member accounts are not automatically deleted when the team owner's account is deleted — team members must request deletion independently if desired
  • Subscription fees paid before deletion are not refunded unless eligible under our Refund Policy

21. Governing Law & Disputes

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from these Terms or your use of OAP that cannot be resolved amicably within 30 days shall be referred to arbitration under the Arbitration and Conciliation Act (Cap A18 LFN 2004) in Lagos, Nigeria.

22. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by email at least 14 days before they take effect. Your continued use of OAP after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must close your account before the effective date.

23. Accessibility

On Air Proof is committed to providing an accessible platform for all users, including those with disabilities. Our website is designed and continuously tested to meet WCAG 2.1 Level AA accessibility standards.

Our Accessibility Commitments:

  • Full keyboard navigation throughout the platform
  • Compatibility with assistive technologies (screen readers, voice control)
  • Sufficient color contrast for readability
  • Properly labeled and associated form controls
  • Responsive design that works on all devices
  • Clear page structure using semantic HTML
  • Regular accessibility audits and testing

Limitations: Some third-party integrations (payment gateways, analytics tools) may not fully comply with accessibility standards due to factors beyond our control. We work continuously to minimize these limitations.
